Terms of use

Article 1 (Purpose)

These Terms and Conditions govern the rights, obligations, and responsibilities of the cyber mall and users regarding the use of internet-related services (hereinafter referred to as the “Services”) provided by bluedmx (hereinafter referred to as the “Mall”), operated by Cellighting Co., Ltd. (an e-commerce business operator).

※「These terms and conditions shall also apply mutatis mutandis to electronic commerce conducted via PC communications, wireless networks, and other means, provided such application does not conflict with their nature.」

Article 2 (Definitions)

  • ① The “mall” refers to a virtual business space established by Cellighting Co., Ltd. to enable users to transact goods or services (hereinafter referred to as “goods, etc.”) using computer or other information communication facilities for the purpose of providing such goods, etc. to users. It is also used to denote the business operator managing the cyber.
  • ② “User” means any member or non-member who accesses the “Mall” and receives the services provided by the Mall in accordance with these Terms.
  • ③ “Member” refers to an individual who has registered as a member on the ‘Mall’ and is eligible to continuously use the services provided by the “Mall.”
  • ④ “Non-member” refers to a person who uses the services provided by the “mall” without registering as a member.

Article 3 (Disclosure, Explanation, and Amendment of Terms and Conditions)

  • ① The “Mall” shall post the contents of these Terms and Conditions, its trade name and representative's name, business location address (including the address where consumer complaints can be handled), telephone number, fax number, email address, business registration number, mail-order business registration number, and personal information protection officer on the initial service screen (front page) of the “Mall” so that users can easily access this information. However, the content of the Terms and Conditions shall be made available for users to view via a linked screen.
  • ② The “mall” must provide a separate linked screen or pop-up screen to ensure the user understands important terms specified in the terms and conditions—such as cancellation of subscription, delivery responsibility, and refund conditions— before the user agrees to the terms and conditions, thereby seeking the user's confirmation.
  • ③ The Mall may amend these Terms and Conditions, provided that such amendments do not violate the [Act on Consumer Protection in Electronic Commerce, etc.], [Act on the Regulation of Terms and Conditions], [Framework Act on Electronic Documents and Electronic Transactions], the [Electronic Financial Transactions Act, Electronic Signature Act], the [Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.], the [Door-to-Door Sales Act], and the [Basic Consumer Act].
  • ④ When the Mall revises its terms and conditions, it shall notify users by posting the revised terms alongside the current terms on the Mall's homepage, specifying the effective date and reason for revision, starting from 7 days prior to the effective date until the day before the effective date. However, if the terms and conditions are changed in a manner unfavorable to users, we will provide at least 30 days' advance notice. In such cases, the “Mall” will clearly compare the pre-revision and post-revision terms to ensure users can easily understand the changes.
  • ⑤ When “Mall” revises its terms and conditions, the revised terms shall apply only to contracts entered into after the effective date of the revision. For contracts entered into prior to that date, the original terms and conditions shall remain in full force and effect. However, if a user who has already entered into a contract sends a request to the “Mall” within the notice period for the revised terms and conditions under Paragraph 3, expressing their desire to be subject to the revised terms and conditions, and obtains the “Mall's” consent, the revised terms and conditions shall apply.
  • ⑥ Matters not specified in these Terms and Conditions and the interpretation thereof shall be governed by the Act on Consumer Protection in Electronic Commerce, etc., the Act on the Regulation of Terms and Conditions, the Fair Trade Commission's Guidelines for Consumer Protection in Electronic Commerce, etc., and other relevant laws, regulations, or established practices shall apply.

Article 4 (Provision and Modification of Services)

  • The mall performs the following tasks:
    • Providing information about goods or services and concluding purchase contracts
    • Delivery of goods or services for which a purchase contract has been concluded
    • Other duties as assigned by the “Mall”
  • The Mall may modify the content of goods or services to be provided under future contracts in cases such as changes to the quality or technical specifications of goods or services. In such cases, the Mall shall immediately notify customers by posting the modified content and the date of provision in the same location where the current content is displayed.
  • When the “Mall” changes the content of services contracted with users due to reasons such as goods being out of stock or changes in technical specifications, it shall immediately notify users of the reason at an address where notification is possible.
  • In such cases, the ‘Mall’ shall compensate users for damages incurred as a result. However, this shall not apply if the “Mall” proves it had no intent or negligence.

Article 5 (Suspension of Service)

  • ① “Mall” may temporarily suspend service provision in the event of maintenance, inspection, replacement, or failure of computer or other information and communications equipment, or disruption of communications.
  • ② The “Mall” shall compensate users or third parties for damages incurred due to the temporary suspension of service provision for the reasons stated in Paragraph 1. However, this shall not apply if the “Mall” proves it had no intent or negligence.
  • ③ In the event that the “Mall” becomes unable to provide services due to reasons such as a change in business type, abandonment of business, or merger between companies, the ‘Mall’ shall notify users in the manner prescribed in Article 8 and compensate consumers according to the conditions originally presented by the “Mall”. However, if the “Mall” has not notified users of compensation standards, etc., it shall pay users their mileage or accumulated points in kind or cash equivalent to the currency value in use at the “Mall.”

Article 6 (Membership)

  • ① Users apply for membership by filling out the membership information in the registration form provided by the “Mall” and expressing their agreement to these Terms and Conditions.
  • ② “Mall” shall register as a member any user who applies for membership as described in Paragraph 1, provided that such user does not fall under any of the following categories.
    • If the applicant has previously lost membership status pursuant to Article 7, Paragraph 3 of these Terms and Conditions. However, this shall not apply to individuals who have obtained the Mall's approval for reinstatement after three years have elapsed since the loss of membership status under Article 7, Paragraph 3.
    • In cases where the registration information contains falsehoods, omissions, or errors.
    • When registering as a general member is deemed to cause significant technical disruption to the “mall.”
  • ③ The membership agreement is deemed established when the Mall's acceptance reaches the member.
  • ④ Members must notify the “Mall” of any changes to the information registered during membership sign-up within a reasonable period by modifying their member information or other appropriate means.

Article 7. (Withdrawal of Membership and Loss of Qualifications, etc.)

  • ① Members may request withdrawal from the “Mall” at any time, and the “Mall” will process the withdrawal immediately.
  • ② The “Mall” may restrict or suspend a member's membership if the member falls under any of the following circumstances:
    • In the event that false information is registered during the application process.
    • If a member fails to pay by the due date for goods purchased using the “Mall” or other debts incurred in connection with using the “Mall”.
    • When threatening the order of electronic commerce by interfering with others' use of “Mall” or misappropriating their information, etc.
    • Using the “mall” to engage in acts prohibited by laws or regulations or these Terms and Conditions, or acts contrary to public order and morals
  • ③ If a member's account is restricted or suspended by the “Mall,” and the same violation is repeated two or more times, or the reason for the restriction/suspension is not resolved within 30 days, the “Mall” may terminate the member's account.
  • ④ When a member loses their membership status, their member information will be deleted. In such cases, the member will be notified and given an opportunity to present their case within a minimum period of 30 days prior to the deletion of their membership registration.

Article 8 (Notice to Members)

  • ① When the “Mall” notifies members, it may do so via the email address designated by the member in advance through an agreement with the “Mall.”
  • ② The “Mall” may substitute individual notifications by posting notices on the “Mall” bulletin board for at least one week when notifying unspecified members. However, individual notifications shall be provided for matters significantly affecting the member's own transactions.

Article 9 (Purchase Application)

  • ① Users of the “Mall” submit purchase requests on the ‘Mall’ using the following or similar methods, and the “Mall” must clearly provide the following details when users submit purchase requests:
    • 1. Searching for and selecting goods, etc.
    • 2. Recipient's name, address, phone number, email address (or mobile phone number), etc.
    • 3. Confirmation of terms and conditions, services subject to restrictions on the right of withdrawal, and cost burdens related to shipping fees and installation charges.
    • 4. A mark indicating agreement to these terms and confirmation or rejection of the matters in Item 3 above. (e.g., mouse click)
    • 5. Agreement to purchase goods and services, confirmation thereof, or consent to the “Mall's” confirmation.
    • 6. Selecting a payment method.
  • ② " When the “Mall” needs to provide or entrust a buyer's personal information to a third party, it must obtain the buyer's consent at the time of the actual purchase request and does not obtain blanket consent during membership registration. At this time, the “Mall” must clearly specify to the buyer the items of personal information being provided, the purpose of use of the personal information by the recipient, and the retention and use period. However, in cases of entrusting personal information processing pursuant to Article 25, Paragraph 1 of the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., if relevant laws and regulations stipulate otherwise, such provisions shall prevail.

Article 10 (Formation of Contract)

  • ① The Mall may refuse to accept a purchase application as described in Article 9 if it falls under any of the following items. However, when entering into a contract with a minor, the Mall must notify the minor or their legal representative that the contract may be canceled if consent from the legal representative is not obtained.
    • 1. In cases where the application contains false information, omissions, or errors.
    • 2. When a minor purchases goods or services prohibited under the Youth Protection Act, such as tobacco or alcohol.
    • 3. When accepting other purchase requests is deemed to cause significant technical difficulties for the “mall.”
  • ② The contract shall be deemed concluded at the time the consent of “Mall” reaches the user in the form of a delivery confirmation notice as stipulated in Article 12, Paragraph 1.
  • ③ The mall's expression of consent must include information regarding confirmation of the user's purchase request, availability for sale, and the correction or cancellation of the purchase request.

Article 11 (Payment Method)

  • Various account transfers such as phone banking, internet banking, and mail banking.
  • Prepaid cards, debit cards, credit cards, and other card payments.
  • Online bank transfer.
  • Payment via electronic money.
  • Payment upon delivery.
  • Payment using points issued by “Mall,” such as mileage points.
  • Payment made using gift certificates contracted with or authorized by the “mall”.
  • Payment of funds via other electronic payment methods, etc.

Article 12 (Notification of Receipt, Modification, and Cancellation of Purchase Applications)

  • ① The mall sends a receipt confirmation notice to the user when a purchase request is made.
  • ② Upon receiving a delivery confirmation notice, the user may immediately request changes or cancellation of the purchase application if there is a discrepancy in the expression of intent. The “mall” must promptly process such requests before shipment if requested by the user. However, if payment has already been made, the provisions regarding withdrawal of application under Article 15 shall apply.

Article 13 (Supply of Goods, etc.)

  • ① Unless otherwise agreed upon with the user regarding the timing of supply of goods, etc., the “Mall” shall take necessary measures such as custom manufacturing and packaging to deliver the goods, etc., within 7 days from the date the user placed the order. However, if the “Mall” has already received all or part of the payment for the goods, etc., it shall take such measures within 3 business days from the date of receiving all or part of the payment. At this time, the “Mall” shall take appropriate measures to enable the user to confirm the supply procedures and progress of the goods.
  • ② The “Mall” specifies the shipping method, the party responsible for shipping costs per method, and the shipping period per method for goods purchased by the user. If the ‘Mall’ exceeds the agreed-upon shipping period, it must compensate the user for any resulting damages. However, this does not apply if the “Mall” proves it acted without intent or negligence.

Article 14 (Refund)

When goods ordered by a user cannot be delivered or provided due to reasons such as being out of stock, the mall shall notify the user of the reason. If payment for the goods has been received in advance, the mall shall refund the payment within three business days from the date of receipt or take necessary measures for the refund.

Article 15 (Cancellation of Subscription, etc.)

  • ① A user who has entered into a contract with the “mall” for the purchase of goods, etc., may withdraw their application within 7 days from the date they received the contract details in writing pursuant to Article 13, Paragraph 2 of the [Act on Consumer Protection in Electronic Commerce, etc.] (if the supply of goods, etc., occurs later than the receipt of such written document, this refers to the date the goods, etc., were supplied or the date the supply of goods, etc., commenced). However, if the Consumer Protection Act in Electronic Commerce, etc. contains different provisions regarding withdrawal of an offer, such provisions shall apply.
  • ② Users may not return or exchange goods received under any of the following circumstances:
    • If goods are lost or damaged due to reasons attributable to the user. (However, if the packaging is damaged solely to inspect the contents of the goods, the user may withdraw the application.)
    • When the value of goods has significantly decreased due to the user's use or partial consumption.
    • When the value of goods or other items has significantly decreased over time to the extent that resale becomes difficult.
    • In cases where goods with identical performance can be replicated, if the packaging of the original goods is damaged.
  • ③ In the cases specified in Paragraph 2, Items 2 through 4, if the “mall” has not clearly stated in a place easily accessible to consumers that the right to withdraw an application is restricted, or has not taken measures such as providing a trial product, the user's right to withdraw the application shall not be restricted.
  • ④ Users may withdraw their application within three months from the date of receiving the goods, or within 30 days from the date they became aware or should have become aware of the fact, if the goods differ from the displayed or advertised content or are performed differently from the contract terms, notwithstanding the provisions of Paragraphs 1 and 2.

Article 16 (Effect of Cancellation of Subscription, etc.)

  • ① The “Mall” shall refund the amount paid for goods, etc., received from the user within three business days. In the event the “Mall” delays the refund of goods, etc., to the user, it shall pay natural interest calculated by multiplying the delay period by the delay interest rate specified in Article 21, Paragraph 2 of the Enforcement Decree of the Act on Consumer Protection in Electronic Commerce, etc.
  • ② When refunding the above amount, the Mall shall promptly request the business that provided the payment method (such as a credit card or electronic money) used by the user to pay for the goods to suspend or cancel the claim for payment of the goods.
  • ③ In cases of withdrawal of subscription, the user shall bear the costs necessary for returning the supplied goods. The “Mall” shall not claim liquidated damages or compensation for damages from the user on the grounds of withdrawal of subscription. However, if withdrawal of subscription occurs because the goods differ from the displayed or advertised content or are performed differently from the contract terms, the “Mall” shall bear the costs necessary for returning the goods.
  • ④ When a user bears shipping costs upon receiving goods, etc., the “mall” clearly indicates who bears those costs upon withdrawal of the offer to make it easy to understand.

Article 17 (Personal Information Protection)

  • ① Mall collects only the minimum necessary personal information from users within the scope required for providing services.
  • ② Mall does not collect information necessary for fulfilling purchase contracts in advance during membership registration. However, this does not apply when collecting minimal specific personal information is necessary for identity verification prior to the purchase contract to fulfill obligations under relevant laws and regulations.
  • ③ When collecting and using a user's personal information, 'Mall" notifies the user of the purpose and obtains consent.
  • ④ "Mall" may not use collected personal information for purposes other than those specified. Should a new purpose arise or if the information is to be provided to a third party, the user shall be notified of the purpose at the time of use or provision and consent shall be obtained. However, this shall not apply where otherwise stipulated by relevant laws and regulations.
  • ⑤ When “Mall” must obtain user consent pursuant to Paragraphs 2 and 3, it shall provide the following information: the identity of the personal information protection officer (affiliation, name, phone number, and other contact details); the purpose of collecting and using the information; and details regarding the provision of information to third parties (recipient, purpose of provision, and content of information to be provided). Users may withdraw this consent at any time.
  • ⑥ Users may request access to and correction of errors in their personal information held by the “Mall” at any time, and the ‘Mall’ is obligated to take necessary measures without delay. If a user requests correction of an error, the “Mall” shall not use the relevant personal information until the error is corrected.
  • ⑦ "Mall" shall limit the number of individuals processing users' personal information to the minimum necessary for privacy protection. "Mall' shall bear full responsibility for any damages incurred by users due to the loss, theft, leakage, unauthorized disclosure to third parties, or alteration of users' personal information, including credit card and bank account details.
  • ⑧ “Mall” or any third party that has received personal information from it shall destroy such personal information without delay once the purpose for which it was collected or provided has been achieved.
  • ⑨ The “Mall” does not preselect consent boxes regarding the collection, use, and provision of personal information. Furthermore, it clearly specifies the services that may be restricted if a user refuses consent for the collection, use, and provision of personal information. It does not restrict or refuse service provision, such as membership registration, based on a user's refusal to consent to the collection, use, or provision of personal information that is not a mandatory collection item.

Article 18 (Obligations of “Mall”)

  • ① "Mall" shall not engage in any acts prohibited by laws and regulations or these Terms and Conditions, or acts contrary to public order and morals, and shall make every effort to provide goods and services continuously and stably in accordance with these Terms and Conditions.
  • ② The mall must implement security systems to protect users' personal information (including credit information) so that users can safely use internet services.
  • ③ The mall shall be liable to compensate users for damages incurred when it engages in unfair labeling or advertising practices as defined in Article 3 of the [Act on Fair Labeling and Advertising] with respect to goods or services.
  • ④ "Mall" does not send unsolicited commercial emails for profit.

Article 19 (Member's Obligations Regarding ID and Password)

  • ① Except as provided in Article 17, the responsibility for managing your ID and password lies with you.
  • ② Members must not allow third parties to use their ID and password.
  • ③ If a member becomes aware that their ID and password have been stolen or are being used by a third party, they must immediately notify the “Mall” and follow any instructions provided by the “Mall.”

Article 20 (User's Obligations)

Users must not engage in the following acts.

  • Registration of false information during application or modification.
  • Identity theft.
  • Changes to information posted on the “mall”.
  • Transmission or posting of information (such as computer programs) other than that specified by the “mall.”
  • Infringement of intellectual property rights, including copyrights, belonging to “Mall” or other third parties.
  • Acts that damage the reputation of “Mall” or other third parties or interfere with their business operations.
  • Posting or publishing obscene or violent messages, images, or audio, or other information contrary to public order and morals on the mall.

Article 21 (Relationship Between the Connecting “Mall” and the Connected “Mall”)

  • ① When a parent “mall” and a child “mall” are linked via hyperlinks (e.g., hyperlink targets include text, images, and videos), the former is called the linking ‘mall’ (website) and the latter is called the linked “mall” (website).
  • ② The linking “mall” shall not be liable for any warranty regarding transactions conducted between users and the linked ‘mall’ for goods or services provided independently by the linked “mall,” provided that the linking “mall” clearly states this disclaimer on its initial screen or via a pop-up screen displayed at the time of linking.

Article 22 (Attribution of Copyright and Restrictions on Use)

  • ① All copyrights and other intellectual property rights in the works created by “Mall” belong to “Mall”.
  • ② Users shall not reproduce, transmit, publish, distribute, broadcast, or otherwise use for commercial purposes any information obtained through the use of the “Mall” for which the Mall holds intellectual property rights, nor shall they allow any third party to use such information, without the prior consent of the Mall.
  • ③ “Mall” must notify the user when using copyrights assigned to that user under the agreement.

Article 23 (Dispute Resolution)

  • ① Mall establishes and operates a damage compensation processing system to reflect legitimate opinions or complaints raised by users and to handle compensation for damages.
  • ② The mall prioritizes handling complaints and feedback submitted by users. However, if prompt resolution is difficult, we will immediately notify the user of the reason and the processing schedule.
  • ③ In cases where a user files a claim for relief regarding an e-commerce dispute arising between the “mall” and the user, the matter may be subject to mediation by a dispute resolution agency commissioned by the Fair Trade Commission or the mayor or governor of a city or province.

Article 24 (Jurisdiction and Governing Law)

  • ① Any lawsuit concerning an e-commerce dispute arising between the “Mall” and a user shall be subject to the exclusive jurisdiction of the district court having jurisdiction over the user's address at the time of filing the lawsuit. If the user has no address, the court having jurisdiction over the user's place of residence shall have exclusive jurisdiction. However, if the user's address or place of residence is unclear at the time of filing, or if the user is a foreign resident, the case shall be filed with the court having jurisdiction under the Civil Procedure Act.
  • ② Korean law applies to e-commerce lawsuits filed between “Mall” and its users.

이름, 생년월일, 성별, 로그인ID, 비밀번호, 자택 전화번호, 휴대전화번호, 이메일, 14세미만 가입자의 경우 법정대리인의 정보

개인정보의 보유기간 및 이용기간

원칙적으로, 개인정보 수집 및 이용목적이 달성된 후에는 해당 정보를 지체 없이 파기합니다. 단, 다음의 정보에 대해서는 아래의 이유로 명시한 기간 동안 보존합니다.
